Hyde Park Winter Wonderland Ultimate Fan Competition – Privacy Notice and Terms & Conditions

DATA PRIVACY: Your personal data will be processed and stored in the UK by the Controller, PWR Events Limited, a private limited company with company number 03827071 whose registered office is at Building 6, Chiswick Park, 566 Chiswick High Road, London, W4 5HR, for the purposes of administering the Prize Draw, notification of winning contestants and awarding prizes.  We collect personal information you give us such as your name and contact details for this purpose.  For more information please see our Privacy Policy or contact [email protected].

TERMS AND CONDITIONS: By entering the Competition you will be deemed to be bound by and have accepted these Terms & Conditions. This Hyde Park Winter Wonderland Ultimate Fan Competition is open to all residents of the UK aged 18 or over except for employees of the Promoter (as defined below), or any member of its group of companies, their immediate families or anyone connected professionally to Hyde Park Winter Wonderland

Definitions:

Competition means the Hyde Park Winter Wonderland Ultimate Fan Competition.

Competition Winner(s) means the winner(s) of the Competition as determined by the judges pursuant to paragraph 5.

Entrant means any individual who has entered the Competition in accordance with the Terms and Conditions and who adheres to any relevant entry and eligibility requirements.

Entry means any entry into the Competition submitted by an Entrant, subject to these Terms and Conditions.

Event means Hyde Park Winter Wonderland 2024/25.

Google Form means the Google form provided by the Promoter for Entrants to submit their video file entries into the Competition.

Prize means the prize described in paragraph 6.

Promoter means PWR Events Limited, a private limited company with company number 03827071 whose registered office is at Building 6, Chiswick Park, 566 Chiswick High Road, London, W4 5HR.

Terms and Conditions means the terms and conditions set out in this document.

Terms and Conditions:

1. This Competition will open on Instagram/TikTok at 12pm BST on 3 October 2024 and will close at 12pm GMT on 3 November 2024. Only entries submitted by publishing on Instagram or TikTok or submitting to the Google Form by 12pm GMT on the Closing Date will be accepted.
2. By submitting a video to the Competition, the Entrant agrees to be bound by the rules (as determined by the Promoter) and these Terms and Conditions.
3. The Competition is free to enter and no purchase is necessary.
4. For Entrants to enter the competition:
   1. Create a video explaining why they are the Ultimate Fan; and
   2. Either
      1. Publish the video on a public Instagram or TikTok profile and tag @hydeparkwinterwonderland & #UltimateHPWWFan; OR
      2. Submit the video file to the Google Form.
   3. All qualifying entries will be judged from early-November to mid-November 2024. Judges will pick three winners (the “Competition Winners”). Each of the Competition Winners will be notified via their social media account or email address. The judges’ decisions shall be final and binding in all matters and no correspondence will be entered into.
   4. The Competition Winners shall each receive:
      250. The ultimate day out at Hyde Park Winter Wonderland including rides, attractions, food & drink with a value up to £250. The chosen rides, attractions, food & drink will be discussed with the Competition Winner (but ultimately determined by the Promoter) and tickets/vouchers will be distributed for them to collect at the Event; and
      251. A merchandise bundle to be collected on their visit.
   5. The Competition Winners’ ultimate day out at Hyde Park Winter Wonderland (as described in paragraph 6) shall be filmed by the Promoter’s videography team and the footage, along with the Competition Winners’ Entry video shall be included in the ‘Behind the Wonder’ video content series.
   6. If the Competition Winners are not able to accept the Prize, no alternative or replacement Prize will be offered.
   7. The Promoter reserves the right to offer an alternative prize of the same or higher value, where it becomes necessary to do so, as decided by the Promoter in its sole discretion.
   8. In the event that the Promoter is unable to contact the Competition Winners within five (5) working days of the email being sent, the Prize will be forfeited and the Promoter will pick a replacement Competition Winner from the remaining Entrants. The Prize will also be forfeited if, at any time, the Competition Winner is found to have been ineligible to enter the competition.
   9. The Prize is non-transferable, non-exchangeable and no cash alternative to the Prize is available.
   10. By entering the Competition, each Entrant grants the Promoter a worldwide, sole, royalty-free perpetual and irrevocable licence to use the copyright in their Entry in order to assess all Entries received and to use on all Hyde Park Winter Wonderland channels and Hyde Park Winter Wonderland social platforms. Please note, for the avoidance of doubt, this licence fully reserves the right of the Entrant to fully exploit the copyright in the Entry themselves.
   11. By entering the Competition each Entrant agrees that (i) the Entry may be used by the Promoter in any associated publicity with the Event (and any future Hyde Park Winter Wonderland events), including the Promoter’s social media channels and website and (ii) the video may be displayed at the Event together with the Entrant’s first name, (such display will be available from Thursday 20th November 2024 – Sunday 5th January 2025 but the Promoter reserves the right to change these dates).
   12. The Promoter reserves the right to withdraw an Entry from the Competition at any time if the Entry is deemed inappropriate for any reason.
   13. The Promoter reserves the right to withdraw an Entrant from the Competition if an Entrant is found to have breached any of these Terms and Conditions.
   14. Entries/videos should not contain any obscene, blasphemous or defamatory matter.
   15. Save in respect of personal injury, death or fraud, the Promoter shall have no liability whatsoever to any Entrant whether in contract, tort or otherwise, in connection with their Entry or any other aspect of this Competition.
   16. Only entries submitted on or before the closing date (described in paragraph 1) and conforming to these Terms & Conditions are eligible to participate. No responsibility can be accepted for entries that are not properly received due to communications beyond the Promoter’s control or for entries that are incorrectly submitted, incomplete or received after the closing date.
   17. This Competition is not sponsored, administered or associated with social media platform(s); any enquiries in relation to it should be addressed to Hyde Park Winter Wonderland
   18. The decision of the Promoter regarding any aspect of the Competition is final and binding in all matters and no correspondence will be entered into.
   19. These Terms and Conditions, and all aspects of the Competition shall be governed by English law and shall be subject to the jurisdiction of the courts of England and Wales.
   20. The Promoter reserves the right to alter these Terms and Conditions of the Competition.
   21. The Promoter reserves the right to cancel the Competition at any time, if deemed necessary or if circumstances arise outside of the Promoter’s control.
